14.08.2008 - Czech govt may deal with Diag Human case on Wednesday

The cabinet is to decide on the state's further steps in the case. Julinek will propose to the government that it use all possibilities of reviewing the decision. According to the arbitration verdict, the Czech Republic must pay 8.33 billion crowns to Diag Human as compensation as from July 2007.

billion. Julinek today reiterated that Diag Human's evidence about the alleged damage caused by the Czech Republic was poor and did not justify the payment of any compensation. "The alleged damage is proved in a conditional aspect: If the market had been good here and if we had had weak competitors, we would have had such and such profit and would have earned four billion. We lost it since minister Bojar wrote a letter in 1992," said Julinek, adding it was a Czech and not international arbitration so its verdict is not final. The case was triggered by a letter that then health minister Martin Bojar wrote to the Danish company Novo Nordisk in 1992 after which the firm cut cooperation with Diag Human. Diag Human then demanded 14 billion crowns in compensation for the state having allegedly destroyed its lucrative deals with blood plasma in the early 1990s. In 1998 already another arbitration panel recognised Diag Human's claim to compensation by the Czech Republic and a public apology. Since then the dispute has only been over the level of compensation. In 2002, the government of PM Vladimir Spidla (Social Democrats, CSSD) paid 326.6 million crowns to Diag Human in compensation. However, the company then calculated new damage. Julinek today said the sum of over 326 million crowns was more than enough. He recalled that he had "inherited the case." He also said the state had not taken "clever and strategic steps" in the case. His deputy Marek Snajdr said the current strategy is to lower the possible impact on the budget to the minimum. At present lawyers are studying the 110-page arbitrators' decision. A new arbitration panel would possibly re-assess the case. ($1=16.065 crowns)
