The ruling also requires Samak's cabinet to resign. Thailand's ruling People Power Party have said they will re-nominate Samak to be Prime Minister. The Thai constitution allows the Prime Minister to return to the post if members of parliament vote him back in to power. Anti-government protesters have occupied the grounds of Samak's office demanding his resignation since late August.
